On November 15, the U.S. District Court for the Eastern District of Texas ruled to strike down the U.S. Department of Labor (DOL) final rule regarding the minimum salary threshold for determining exemption from overtime payments. The ruling strikes down all aspects of the rule, eliminating both the July 1, 2024, and January 1, 2025, salary thresholds, as well as the triennial automatic updates. As a result, the salary threshold for exemption is effective back to the 2019 overtime level of $35,568 annually.
Given this development, the planned reclassification of employees based on the January 1, 2025, salary threshold will not take place. Reclassifications previously made due to the July 1, 2024, salary threshold are under review and more communication will follow. Until then, employees affected by the July 1, 2024, portion of the regulation will remain non-exempt and should continue to complete timesheets.
